Right of Withdrawal

Statutory Right of Withdrawal

As a consumer, you generally have a statutory right of withdrawal for contracts concluded online pursuant to Sections 355(1) and 312g(1) of the German Civil Code (BGB).

Pursuant to Section 312g(2) no. 1 BGB, the right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose manufacture an individual choice or decision by the consumer is decisive, or that are clearly tailored to the consumer’s personal needs.

Each DNA jewellery item is individually made for the respective order, and the submitted biological sample material is permanently applied to the rough diamond. This creates a uniquely personalised item that is assigned to the respective person or animal.

The complete and verifiably residue-free removal of the incorporated sample material cannot be guaranteed. The jewellery item therefore cannot be reused or resold to another customer without the risk of commingling or misattribution. Such commingling could, in particular, compromise any subsequent analysis and the unambiguous attribution of the DNA contained in the jewellery.

There is therefore no statutory right of withdrawal for our individually made DNA jewellery. Your statutory rights in the event of defects remain unaffected.

Voluntary Contractual Right of Cancellation

Irrespective of the exclusion of the statutory right of withdrawal, DNArchiv voluntarily grants consumers the right to cancel the contract within seven days of its conclusion without stating any reasons.

Under our Terms and Conditions, the contract is concluded when you receive our order confirmation by email. The seven-day period begins on the following day. Sending the cancellation notice before the deadline is sufficient to meet the cancellation period.

During these seven days, DNArchiv will not begin the permanent processing of the submitted biological sample material.

To exercise your right of cancellation, you must inform us of your decision by means of a clear statement. You may send your statement by email to info@dnarchiv.de.

 

To help us identify your order, please provide your name and your order or invoice number. If you wish to cancel only individual products from an order, please also specify the relevant products and quantities. Missing information will not prevent cancellation if the affected order can otherwise be clearly identified.

 

DNArchiv will confirm receipt of the cancellation without undue delay by email. The validity of the cancellation does not depend on this confirmation.

If the contract is cancelled within the applicable period, we will refund the purchase price attributable to the cancelled products no later than 14 days after receiving the cancellation notice. As a general rule, we will use the same payment method that you used for the original transaction. You will not incur any additional costs as a result of the refund.

You do not need to return a sample collection kit that you have already received. Any sample material already received by DNArchiv will not be processed and will be professionally disposed of, unless expressly agreed otherwise with you.
